Educational Court Cases
Daniel v. State of California (Los Angeles Superior Court)
On July 27, 1999, the ACLU filed a suit on behalf of California high schools students who are being denied equal and adequate access to Advanced Placement courses by their local school districts and the state of California. The defendents in this case are the State of California, the State Superintendent of Public Instruction, the State Board of Education, the Inglewood Unified School District, and the Superintendent of the Inglewood Unified School District.

The named plaintiffs are African-American and Latino high school students enrolled at Inglewood High School. The ACLU argues that the allocation of Advanced Placement courses are unequal across California, with low-income and minority students being denied equal access to these rigorous classes. As a result, these students are disproportionately disadvantaged in the quality of their high school curriciulum and their opportunities to pursue and succeed in higher education.

Serna v. Eastin (Superior Court of California)
In July, 1997, the ACLU filed a class action lawsuit on behalf of the parents and guardians of Compton Unified School District students. The ACLU alleges that the State Superintendent of Public Instructions and others failed to provide an equal and adequate education in a safe environment for Compton students after taking over the school district in 1993.

The suit maintains that the state has violated the California Constitution and the state’s education code, depriving students of basic educational opportunities, including textbooks, unusable toilets, and uninhabitable facilities.

Williams et al. v. State of California et al. (Superior Court, San Francisco)
The ACLU filed suit against the State of California on May 17, 2000. Symbolically filed on the 46th anniversary of the Brown v. Board of Education Decision, this lawsuit maintains that the State of California is denying public school children basic educational opportunities because they attend schools that lack necessary learning tools such as credentialed teachers, textbooks, and seats for students. The ACLU claims that the suit has failed to honor the state constitutional by failing to provide students with bare essentials necessary to educate students. Additionally, the suit alleges the state violated federal and state requirements that equal educational access be granted without regard to race.

The lawsuit challenges that students are being denied their right to equal protection under the law because they must learn under substandard conditions. In addition, the ACLU asserts that the conditions of the schools has a racially discriminatory effect on these children, most of whom are students of color.
